1. INTRODUCTION

www.pursuefitness.com (referred to as the “website") is owned and operated by Pursue Fitness Ltd (referred to as "Pursue Fitness” and/or “us”). Pursue Fitness is a company incorporated and registered in England and Wales with company number 08687090 and VAT registration number 177767155.

By placing an order on this website you agree to the below Terms, Conditions and Purchasing Terms which will create the sales contract, between yourself and Pursue Fitness at the point of order confirmation and acceptance.

 

2. PLACING AN ORDER

How you can place an order:

  • Add the products you want on the website to your basket
  • Ensure you select the correct size before adding the items to your basket
  • Once you have added all items you would like to purchase, proceed to checkout
  • You must your provide billing, shipping, email address, and all other required details accurately
  • Review the order before you complete the purchase
  • Submit the order and you will receive a confirmation email to the email address you provided at checkout.

    2.1 ORDER ACCEPTANCE AND CANCELLATIONS

    All orders submitted by you are subject to acceptance by Pursue Fitness. Pursue Fitness may choose not to accept your order at their discretion. Examples of when Pursue Fitness may not accept your order are as follows:

  • If products are shown on the website but are not in stock at the Pursue Fitness warehouse;
  • If we are unable to obtain authorisation of your payment;
  • If shipping restrictions apply to a product and/or country;
  • If products shown on the website contain a manifest error, such as being incorrectly priced, or otherwise incorrectly described;
  • If a discount code is invalid for the order being placed or is the subject of improper use or fraudulent activity; or
  • If the order or payment type is subject to suspected fraudulent activities.
  • We start to process your order as soon as it is submitted, therefore it is not possible to cancel your order before you have received it. You can cancel your order by returning your goods, following the returns process in section 6 of this agreement.

     

    3. QUALITY AND MAINTENANCE OF PRODUCTS 

    Minor differences in colour and other variations in Products are possible as a result of different image acquisition, display technologies or other technical reasons. Pursue Fitness is not liable for these variations and deviations.

    Pursue Fitness draws your attention to the washing and maintenance instructions printed on the labels of the Products. Pursue Fitness is not liable for any damage resulting from incorrect handling of Products, including handling contrary to the instructions.

     

    4. PRICE AND CURRENCY 

    You can select your local currency via the menu tab on mobile or via the header bar on desktop.

    Prices displayed online usually adjust depending on your geographical location. For example, if you reside in the UK, the currency displayed should be GBP. This function works for GBP, USD, EUR, AUD, CAD, DKK and other major currencies. If you are using a private browser or a VPN this may limit this function on the website.

    Prices quoted at the payment stage are in GBP, USD, EUR, AUD, CAD, DKK and other major currencies, depending on your location and/or the currency you have selected.

    Pursue Fitness reserve the right to:

  • Change, limit or terminate any special offers or discounts at any time;
  • Change, limit or terminate any promotional codes at any time; or
  • Adjust the price of any product on the website at any time.
  • It is possible that, despite our best efforts, some of the products we sell may be incorrectly priced on the website. If you purchase product(s) that are incorrectly priced, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

     

    5. SHIPPING, DELIVERY AND CUSTOMS

    All orders made on the Pursue Fitness website are dispatched from the UK to the shipping address you provide at the checkout stage. Orders are usually delivered on business days, excluding bank holidays and national holidays. However, some couriers will deliver on weekends.

    We aim to despatch orders on the same day as outlined on the Delivery Times page. However, due to fluctuation in order volumes, this is not always possible.

    Any orders with a delivery address in the United Kingdom are domestic, and will not incur any additional customs or import fees.

    Any orders with a delivery address in the 27 EU member states will not be subject to any customs or import fees. We will cover these charges for you, so you don't have to.

    Any orders with a delivery address in the USA, under the value of $800 USD, will not be subject to any customs and import fees.

    Any orders with a delivery address in Australia under the value $1000 AUD, will not be subject to any customs and import fees.

    Any other international orders may be subject to customs and import fees, however different countries have different thresholds (based on the order value) that will be subject to these charges. We are unable to list the various customs and import fees for all countries. We advise you contact your local customs authority for more information regarding any customs and/or import fees you may need to pay upon the delivery of your order. These charges are not quoted at checkout and are out of our control. These charges are billed from your local customs authorities and are not additional fees charged by Pursue Fitness. If you choose to refuse to pay the customs fee and the parcel is returned back to Pursue Fitness, a shipping and handling fee may be deducted from your refund, as this aspect of the order was fulfilled. If you would like us to send the order again we may ask for payment of the delivery fees to re-dispatch your order.

    APO/FPO addresses can only be shipped via a standard delivery service, DHL cannot deliver to these locations. In this case, if DHL is selected at checkout the delivery service will be updated automatically so we can efficiently fulfil your order.

    If two or more orders are placed to the same shipping address, these orders may be sent together. This is to reduce parcel volumes for couriers as well as packaging waste. 

    Any orders returned to us due to an incorrect address, unsuccessful delivery or no collection may have a shipping and handling fee deducted from your refund, as this aspect of the order was fulfilled. If you would like us to send the order again we may ask for payment of the delivery fees to re-dispatch your order.

    Pursue Fitness cannot be held responsible for the delay in delivery of your order, including but not limited to: incorrect customer details (including addresses and contact details), customs clearance, inventory levels, national or private strikes, remote areas, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, weather, natural disasters, fire, pandemics and epidemics, transport and network issues, or the failure of public or private telecommunications.

     

    6. RETURNS: STORE CREDITS, EXCHANGES & REFUNDS 

    Returns information, including the online returns portal link, is located on the Returns Page or at the bottom of every page on the website under 'Returns'.

    Due to hygiene reasons, we cannot accept returns for the following items: Socks, Underwear, Headwear, Towels, Water Bottles & Swimwear.

    Store Credits

    We offer store credits within 30 days from the day you receive your order.

    Store credits are processed within 10 days of us receiving the returned item(s). These are sent to the email address provided to us on your original order.

    Orders placed using split payment (part gift card/store credit, part other payment method) will always be credited to the gift card/store credit first. Any remaining balance will be applied to the store credit.

    During busy periods some returns may be processed outside of the 10 day timeframe.

    Exchanges

    We offer exchanges within 30 days from the day you receive your order.

    You can exchange the same item for a different size or colour (stock dependant).

    Exchanges are processed within 10 days of us receiving the returned item(s) back. Standard delivery times then apply for the exchanged item(s) to be delivered back to you. We do not charge extra to dispatch your exchange item(s) back out to you, this is free of charge.

    During busy periods some returns may be processed outside of the 10 day timeframe.

    Refunds

    We offer refunds within 30 days from the day you receive your order.

    Gift cards are a non-refundable item, this includes unused gift cards and partially used gift cards with an outstanding balance.

    Refunds are processed within 10 days of us receiving the returned item(s). Please allow an extra 7 days for your bank to make the funds available to you.

    Orders placed using split payment (part gift card/store credit, part other payment method) will always be refunded to the gift card/store credit first. Any remaining balance will be refunded to the other payment method used.

    During busy periods some returns may be processed outside of the 10 day timeframe.

    Return Refusal Rights

    International returns (outside of the UK) must be clearly labelled as a 'Customer Return' on any paperwork to avoid incorrect customs charges. You should not state the value you paid for the item(s). For sake of clarity, if you state the item value on paperwork, we will pay import duty, taxes and a processing fee for an item we have not paid you for. This is incorrect as we have not purchased the items from you, you are simply returning them back to us. Any fees we incur, from paperwork filled out incorrectly, will be chargeable or deductible from refunds or store credit.

    We reserve the right to deny processing any returns that are not received to the correct returns address. We therefore request you use a secure and trackable service when sending your return back to us. For some locations (including the UK, USA, and EU) you will be offered a convenient label option within the online returns portal.

    We reserve the right to deny processing any returns processed after 30 days of you receiving your order.

    We reserve the right to refuse returned items that are not received back in a complete saleable condition: brand new, with tags attached, in original packaging, unwashed, without stains, hair, or odours.

     

    7. INTELLECTUAL PROPERTY RIGHTS

    All trademarks, service marks, logos and trade names that appear on Pursue Fitness products, product packaging and/or on the Website, whether registered or not (the “Trade Marks”) remain the exclusive property of Pursue Fitness Ltd. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify any of the Trade Marks in any way, including in advertising or publicity pertaining to distribution of materials on the Website.

     

    8. IOS AND ANDROID APP

    By placing an order on our mobile application (known as Pursue Fitness on the App Store) (the “app”) you agree to the same Terms, Conditions and Purchasing Terms as those detailed throughout this page.

     

    Amendments to Terms and Conditions

    We reserve the right to make changes to these Terms and Conditions at any time.

    The use of this Website as well as any purchase agreement between you and us, will be subject to the version of the Terms and Conditions on this page at the time you place an order or browse the website.
